Guidelines on the Procedures of Three Major Hearing Models

General Provisions:

Article 1 These Guidelines on the Procedures of Three Major Hearing Models (these "Guidelines") are hereby developed in accordance with the provisions of the General Arbitration Rules of China’s Nansha International Arbitration Center (“General Arbitration Rules”), in order to instruct the parties to conduct arbitration in accordance with the Guangzhou, Hong Kong and Macau International Arbitration Models.

Article 2 Unless the parties agree on the application of other arbitration rules, the General Arbitration Rules and the arbitration model guidelines chosen by the parties shall apply; if the parties do not make the choice or fail to reach a consensus on the choice, the Chairman of the Center shall designate the applicable arbitration model guidelines.

These Guidelines shall be an integral part of the General Arbitration Rules, and in the event of any inconsistency between these Guidelines and the General Arbitration Rules, the Chairman of the Center shall decide which one should apply.

Article 3 These Guidelines have been deliberated on and approved at a work meeting of China’s Nansha International Arbitration Center on August 27, 2019, and will enter into force as from September 1, 2019.

Model Arbitration Clauses

Any dispute, controversy, disagreement or claim arising from or in connection with this contract, including the existence, validity, interpretation, performance, breach or termination of this contract, or any non-contractual dispute arising from or in connection with this contract, shall be submitted to China’s Nansha International Arbitration Center for final resolution through arbitration in accordance with the General Arbitration Rules of China’s Nansha International Arbitration Center in effect at the time of submission and by applying the arbitration model guidelines jointly chosen by the parties from the following:

Guidelines on the Procedures of Guangzhou International Arbitration Model;

Guidelines on the Procedures of Hong Kong International Arbitration Model;

Guidelines on the Procedures of Macao International Arbitration Model.
